Curfolio Terms of Use

Preamble

These Terms of Use (hereinafter referred to as the “Terms”) govern access to and use of the Curfolio platform, published by Saydav Group (hereinafter referred to as “Curfolio,” “we,” “us,” or “our”).

By using Curfolio, whether you are a candidate, freelancer, recruiter, company, or simple visitor, you unconditionally accept all of these Terms. If you do not accept these Terms, you may not use our services.

We reserve the right to modify these Terms at any time. The current version is the one accessible online on the date of your use.

1. Definitions

In these Terms, the following terms shall have the meanings set forth below:

• Platform : refers to the Curfolio website and mobile application, as well as all associated services.

• User : refers to any individual or legal entity accessing the Platform, regardless of their status.

• Candidate : refers to a User seeking employment, a freelance mission, or responding to a call for tenders.

• Freelancer : refers to a User who is an independent worker offering their services via the Platform.

• Recruiter / Company : refers to a User publishing job offers, freelance missions, or calls for tenders.

• Account : refers to the personal space created by the User to access the Platform’s services.

• Content : refers to all information, texts, images, CVs, offers, messages, and data published by Users on the Platform.

2. Acceptance of Terms

Use of Curfolio constitutes full and complete acceptance of these Terms. This acceptance is materialized by checking the “I accept the Terms of Use” box when creating an Account, or by any access to the Platform as a visitor.

These Terms prevail over any other document or general conditions issued by the User, unless prior written agreement from Curfolio.

3. Account Creation and Management

3.1 Registration

To access Curfolio’s services, the User must create an Account by providing accurate, complete, and up-to-date information. The User agrees not to create an account on behalf of a third party without their express authorization.

3.2 Account Security

The User is solely responsible for the confidentiality of their login credentials. Any activity conducted from their Account is deemed to be the act of the User. In case of suspected unauthorized use, the User must notify us immediately at support@curfolio.com.

3.3 Account Deletion

The User may delete their Account at any time from their personal space. Curfolio reserves the right to suspend or delete an Account in the event of a violation of these Terms, without notice or compensation.

4. Description of Services

Curfolio is an all-in-one platform enabling:

• For Candidates and Freelancers:

  • CV and portfolio creation and management

  • Search for job offers and freelance missions

  • Response to calls for tenders published by companies

  • Connection with recruiters

  • Management of their professional network

• For Recruiters and Companies:

  • Publication of job offers, freelance missions, and calls for tenders

  • Consultation of candidate and freelancer profiles

  • Management of received applications

  • Access to sourcing and recruitment management tools

Curfolio acts as a matching platform. We are neither an employer, nor a client, nor a service provider for Users. Contractual relationships, including financial, legal, and tax aspects, are concluded directly between Users. Curfolio is not a party to these contracts and disclaims any liability in this regard.

5. User Obligations

5.1 General Obligations

Each User agrees to:

• Provide accurate, truthful, and up-to-date information

• Use the Platform in accordance with its purpose and in good faith

• Respect the rights of other Users

• Not use the Platform for fraudulent, illegal, or contrary to public order purposes

5.2 Published Content

The User is solely responsible for the content they publish on the Platform. They guarantee that this content:

• Complies with applicable laws and regulations

• Does not infringe upon the rights of third parties (image rights, intellectual property, etc.)

• Is not defamatory, insulting, discriminatory, or misleading

Curfolio reserves the right to moderate, suspend, or remove any content that violates these Terms, without notice or compensation.

5.3 Prohibitions

It is strictly forbidden to:

• Publish fictitious, fraudulent offers, or offers without a genuine recruitment intention

• Collect User data without authorization

• Use robots or any automated means to access the Platform

• Attempt to circumvent the Platform’s security systems

6. Liability

6.1 Liability of Curfolio

Curfolio implements the necessary means to ensure the proper functioning of the Platform but cannot guarantee continuous and uninterrupted availability. We reserve the right to interrupt access to the Platform for maintenance, security, or any other legitimate reason.

Curfolio is not liable for:

• Contractual relationships entered into between Users (recruitment, missions, calls for tenders)

• The quality, accuracy, or truthfulness of content published by Users

• Indirect damages, loss of business, loss of data, or loss of revenue

• Damages resulting from fraudulent use of a User’s credentials

6.2 Liability of Users

Each User is solely responsible for their actions on the Platform, their contractual obligations towards other Users, and the direct or indirect consequences of their publications.

7. Intellectual Property

7.1 Curfolio Content

All elements composing the Platform (texts, logos, design, code, databases, etc.) are the exclusive property of Curfolio or its partners. Any unauthorized reproduction, modification, or use is prohibited and may result in legal action.

7.2 User Content

Users retain all intellectual property rights to their content (CVs, offers, etc.). By publishing on Curfolio, they grant us a non-exclusive, worldwide, royalty-free license to host, distribute, and promote this content in the context of the Platform’s operation.

8. Data Protection

Curfolio places the utmost importance on the protection of your personal data. We collect and process your information in accordance with our Privacy Policy, which forms an integral part of these Terms.

You can consult our Privacy Policy separately to learn about:

• The data we collect

• The purposes of processing

• Your rights (access, rectification, erasure, objection, etc.)

• How to exercise these rights

9. Fees and Billing

Access to certain Curfolio services may be subject to fees. Applicable rates are indicated on the Platform and are expressed in euros (EUR) or CFA francs (FCFA) depending on the User’s location, inclusive of all taxes (applicable VAT).

9.1 Payment Methods

Payments are made online by credit card, Mobile Money, or any other method offered on the Platform. Curfolio uses secure payment providers; banking data is not stored by Curfolio.

9.2 No Refunds

In accordance with applicable legal provisions, the services offered by Curfolio are not subject to any refund, in whole or in part, unless required by mandatory law. By validating a purchase, the User acknowledges having been informed of the absence of a withdrawal right for services executed immediately.

9.3 Invoicing

An invoice is made available to the User in their personal space after each purchase.

10. Suspension and Termination

Curfolio reserves the right to suspend or terminate a User’s access to the Platform in the event of:

• Violation of these Terms

• Fraudulent or harmful behavior towards other Users

• Non-payment of amounts due

Suspension or termination occurs without notice and without compensation, without prejudice to any damages Curfolio may claim.

The User may also terminate their Account at any time from their personal space.

11. Applicable Law and Jurisdiction

These Terms are governed by Ivorian law, without prejudice to consumer protection rules applicable in the User’s country of residence.

In the event of a dispute relating to the interpretation, execution, or termination of these Terms, an amicable solution will be sought before any legal action.

Failing amicable agreement, the competent courts will be those within the jurisdiction of the registered office of Saydav Group (Abidjan, Ivory Coast), unless mandatory provisions dictate otherwise.

12. Miscellaneous

12.1 Partial Invalidity

If one or more provisions of these Terms are declared null or unenforceable by virtue of a law, regulation, or decision of a competent court, the other provisions shall retain their full force and effect.

12.2 No Waiver

The fact that Curfolio does not enforce a clause of these Terms does not constitute a waiver of the right to enforce it later.
